By using the Kite API, Dashboard, or any related services, you agree to these terms binding you and Gooick Technologies Pvt. Ltd. ("Gooick", "we", "us"). If you do not agree to these terms, you may not use our services.
Account Usage
You are responsible for maintaining the security and confidentiality of your account credentials. This includes:
- Keeping your API keys secure and never sharing them publicly
- Using strong, unique passwords for your dashboard account
- Enabling multi-factor authentication (MFA) where available
- Immediately notifying us of any unauthorized access or security breach
- Ensuring all users on your team account comply with these terms
You are solely responsible for all activity that occurs under your account. We reserve the right to suspend accounts that show signs of compromise or unauthorized use.
Important: API keys should be treated as passwords. Never commit them to public repositories or share them in client-side code.
Acceptable Use
You agree not to use Kite services to broadcast, store, or distribute any content that:
- Is illegal under applicable law in any jurisdiction
- Contains child sexual abuse material (CSAM) or exploits minors
- Promotes violence, terrorism, or harm against individuals or groups
- Infringes on intellectual property rights of third parties
- Contains malware, viruses, or other harmful code
- Facilitates fraud, phishing, or other deceptive practices
- Violates the privacy rights of others without consent
We reserve the right to immediately terminate accounts and report violations to law enforcement where required. Violation of acceptable use policies may result in permanent ban without refund.
API Limits & Throttling
To ensure platform stability and fair usage for all customers, we implement rate limits and throttling on API requests:

Requests exceeding these limits will receive a 429 Too Many Requests response. We recommend implementing exponential backoff in your integrations.
We reserve the right to adjust rate limits without notice to protect platform integrity. Enterprise customers may negotiate custom limits.
Service Level Agreement (SLA)
We guarantee the following uptime commitments based on your subscription tier:

Creator Plan
99.9%
Business Plan
99.99%
Enterprise Plan
Uptime is calculated monthly, excluding scheduled maintenance windows (announced 48 hours in advance). If we fail to meet these commitments, eligible customers may request service credits:
- 99.0% - 99.9%: 10% credit of monthly fee
- 95.0% - 99.0%: 25% credit of monthly fee
- Below 95.0%: 50% credit of monthly fee
Credits must be requested within 30 days of the incident. Maximum credit is limited to 50% of monthly fees.
Payment & Refunds
All Kite services are billed on a monthly or annual basis, depending on your selected plan. Payment terms:
- Usage is billed at the start of each billing cycle
- Overage charges are calculated and billed at the end of each cycle
- All prices are in USD unless otherwise specified
- Annual plans receive a 20% discount but are non-refundable
- We accept major credit cards and wire transfers (Enterprise only)
Refund Policy
Monthly subscriptions: No refunds for partial months. You may cancel at any time, and your access will continue until the end of the current billing period.
Annual subscriptions: Non-refundable after the 14-day trial period. Contact support within 14 days for a full refund.
Termination
Either party may terminate this agreement:
- You may cancel your subscription at any time through the dashboard
- We may suspend or terminate accounts for violation of these terms
- We may discontinue the service with 90 days notice to active customers
- Upon termination, you lose access to all data and content
Upon termination, you have 30 days to export your data. After this period, all data will be permanently deleted. We are not obligated to retain any of your content after account termination.
Sections regarding limitation of liability, intellectual property, and confidentiality survive termination of this agreement.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
KITE AND GOOICK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Some jurisdictions do not allow limitations on implied warranties or liability. In such cases, the above limitations may not apply to you.
